These terms govern your use of danaandolfatto.com and any page, gallery, or form under that domain (the “Site”), which is operated by Dana Andolfatto Portrait, LLC, a Florida limited liability company (“we,” “us”). By using the Site you agree to these terms and to our Privacy Policy. If you do not agree, please do not use the Site.

THE SITE IS FOR ADULTS

The Site presents boudoir and portrait photography and is intended for visitors who are 18 or older. By using it you confirm that you are at least 18.

WHAT THE SITE IS, AND IS NOT

The Site describes our photography services, shows our work, and lets you contact us. Nothing on the Site is an offer that can be accepted by payment alone, and no booking exists until a Portrait Session Agreement has been signed and a session fee received. Prices shown on the Site are starting points and may change without notice. Nothing on the Site is legal, medical, psychological, or financial advice.

OUR PHOTOGRAPHS AND WORDS BELONG TO US

Every photograph, piece of writing, logo, and design element on the Site is owned by Dana Andolfatto Portrait, LLC or used with permission, and is protected by United States and international copyright and trademark law. You may view the Site and share links to it. You may not copy, download, screenshot, scrape, reproduce, publish, or create derivative works from any photograph or text on the Site, use any of it for commercial purposes, or remove any credit or watermark, without our written permission. You may not use any automated tool to collect content from the Site, and you may not upload any photograph from the Site to an artificial-intelligence tool, generator, or training dataset.

The women in our photographs have each consented to the specific use shown. Any other use of their likeness is a violation of their rights as well as ours.

ABOUT AI ON THE SITE

Our photographs are made in the Studio, of real clients, by Dana Andolfatto. We use editing software, some of which incorporates artificial intelligence, to retouch and finish photographs in our style; we do not use AI to generate photographs of people. Where a graphic or illustration on the Site has been created in whole or in part with generative AI, it is labeled as such. Every image on the Site is an original work of authorship owned by Dana Andolfatto Portrait, LLC.

YOUR CONTACT AND INQUIRIES

When you send us an inquiry or join our mailing list you agree to provide accurate information and to receive the replies and communications described in our Privacy Policy, which also explains how to opt out. Your message to us does not create a client relationship until a Portrait Session Agreement is signed.

LINKS TO OTHER SITES

The Site links to services we do not control, such as social media platforms, booking tools, and online galleries. Their content and privacy practices are their own, and we are not responsible for them.

NO WARRANTIES, AND THE LIMIT OF OUR LIABILITY

The Site is provided as it is and as available. We do not promise that it will be uninterrupted, error-free, or free of harmful components. To the fullest extent Florida law allows, we are not liable for any indirect, incidental, or consequential loss arising from your use of the Site, and our total liability for any claim connected with the Site is limited to $100. These terms do not limit any liability that cannot be limited by law.

YOUR RESPONSIBILITY TO US

If your use of the Site, or your breach of these terms, causes a claim against us, you agree to indemnify us for the resulting loss, including reasonable attorney’s fees.

CHANGES

We may update these terms at any time by posting a new version on the Site with a new effective date. Your continued use of the Site after a change means you accept it.

GOVERNING LAW

These terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. Any dispute arising from the Site or these terms will be brought exclusively in the state or federal courts sitting in Miami-Dade County, Florida, and you consent to their jurisdiction. In any action to enforce these terms, the prevailing party may recover its reasonable attorney’s fees and costs.
